Terms and Conditions

General

Kerstin Graebner conducts her coaching and consulting services in accordance with these Terms and Conditions. By hiring Kerstin Graebner for her services, these terms and conditions are deemed accepted by the client. Any additional agreements are only binding if they have been confirmed in writing by Kerstin Graebner.

The contracts with Kerstin Graebner are service contracts, unless expressly agreed otherwise. Therefore, the contract concerns the provision of the service, not the provision of a certain fixed result. Kerstin Graebner’s coaching and consulting may prepare the client for their own decision-making, but cannot in any way replace it.

Kerstin Graebner may involve support staff, external experts and others in providing the consulting service. Due to valid stipulations, Kerstin Graebner neither promises nor delivers consulting in related to the law and taxation. These subjects are to be provided by the client themselves, if applicable.

Kerstin Graebner offers her services on the basis of the data and information provided by the client or by those commissioned by the client to do so. Kerstin Graebner will check them for plausibility. The responsibility for the factual correctness and completeness rests entirely with the client.

Offers & professional fees

Offers are non-binding and subject to change without notice. All fees are in Euro (EUR). For coaching and consulting services, the professional fees stated in the coaching and consulting agreement will be charged. Any additional costs (such as phone charges, travel costs, etc.) are billed separately.

The online/phone coaching appointments are agreed on between coach and client based on mutual availability. The client owes the coaching and consulting professional fees personally in case no other cost-sharing agreement is in place with any other party (employer, etc.).

The professional fees are due without deduction immediately after invoicing, unless agreed otherwise. Retaining or offsetting the professional fee is only permissible if the client’s entitlement to the same has been accepted by Kerstin Graebner or proven legally.

Appointments

Any booked appointments are generally binding. This includes any free introduction and orientation calls. Time and location are mutually agreed on by the coach and client. The client commits to attend all meetings on time.

Cancellation or rescheduling of coaching sessions is possible free of cost up to 24 hours before the appointment. Afterwards, any cancellation or rescheduling will be invoiced at 50% of the professional fee. In case of a no-show, the full professional fee is invoiced as a cancellation fee.

Force majeure & other service hindrances

Kerstin Graebner may reschedule the booked coaching appointments due to force majeure, which includes other hindrances to the provision of services, like illness, accidents or others.

In this case, the coach will inform the client as quickly as possible and will offer a replacement.

Copyright

All documents handed over to the client are included in the agreed on professional fee, unless agreed otherwise. The documents are intended for the client’s personal use only.

Kerstin Graebner owns the copyright of the coaching concepts and documents. The client is not permitted to reproduce the documents partly or entirely without Kerstin Graebner’s written permission, and cannot make them accessible to third parties. Publication, even in parts, is prohibited.

Insurance coverage

The client bears the full responsibility for themselves and their actions, within and outside of coaching or consulting appointments, and pays for any damages him/herself. Coaching is not psychotherapy and does not replace it. Participation in Kerstin Graebner’s coaching and consulting offers requires a regular level of psychological and physical capacity.

Team coachings, workshops etc. are always officially hosted by the client. Participants therefore do not have insurance coverage via Kerstin Graebner.

Liability

All information, tools and documents in coaching sessions are carefully tried and tested by the coach. Kerstin Graebner’s offers classify as service activities. Therefore, Kerstin Graebner does not owe a certain result or success. Liability is excluded. Sending or electronic transfer of any data happens at the client’s risk.

Confidentiality

Kerstin Graebner is committed to full confidentiality with respect to any of the client’s operational, business and private matters she becomes aware of as a part of the provision of the service. This is true also for after the contract has ended.

An exception may be made to alert the respective authorities in case of imminent danger to the client’s life, or in case of imminent danger to someone else's life at the hand of the client.

Kerstin Graebner also commits to store the documents provided by the client or any notes taken as a part of the engagement carefully as to protect them against unauthorized access.

Client’s obligation to cooperate

Coaching is conducted based on the preparatory conversations by both parties. It is based on cooperation and mutual trust. Kerstin Graebner wants to highlight specifically that coaching is a free, active and self-responsible process which does not guarantee certain predefined results. Instead, Kerstin Graebner accompanies the client’s process as a facilitator, and provides support for decision-making and change processes - the actual work needed for change is done by the client, inside and outside of sessions. The client therefore must be ready and open to reflect on themselves and their own situation, and take appropriate action.

Differentiation from psychotherapy

Coaching is not psychotherapy and does not replace it. Coaching is based on a coach-client relationship which is characterized by an eye-level partnership, thus delineating the coach’s role from that of a therapist or doctor.

Psychotherapy is oriented towards problems and symptoms, seeking to treat mental illnesses or heal wounds of the past that continue to affect the client’s functioning in a significant way in their current day-to-day life. Coaching is solution-oriented and practical, and is intended for the personal and professional development and skill-building of people who are capable of self-reflection, acting and taking decisions in their day-to-day.

The result of coaching is not the healing of psychological symptoms, but the client’s personal or professional development, including a general improvement in the client’s quality of life.

Statement on cults

Kerstin Graebner confirms that sectarian practices are not a part of her own training or the provision of her services, and she expressly rejects sectarian practices of all kinds, distancing herself from any such organizations.

Final clause

If any individual stipulation of the contract, including these terms and conditions, becomes partly or fully invalid, the remaining stipulations remain intact. The invalid stipulation is to be replaced by one which comes closest to the intention of the original clause.

Place of fulfillment & jurisdiction

The place of fulfillment is Heroldsbach, Germany. The place of jurisdiction is the responsible district court, “Amtsgericht Forchheim”.

The laws of the Federal Republic of Germany apply.
